In any action to enforce this Agreement, the prevailing party will be entitled to costs and attorney fees. In the event that any of the provisions of this Agreement are held by a court or other tribunal of competent jurisdiction to be unenforceable, such provisions shall be limited or eliminated to the minimum extent necessary so that this Agreement shall otherwise remain in full force and effect and enforceable. This Agreement constitutes the entire agreement between the parties hereto pertaining to the subject matter hereof, and any and all prior or contemporaneous written or oral agreements existing between the parties hereto are expressly canceled. No waiver by either party of any breach or default hereunder shall be deemed to be a waiver of any preceding or subsequent breach or default. Any heading, caption, or paragraph title contained in this Agreement is inserted only as a matter of convenience and in no way defines or explains any paragraph or provision hereof.

You agree to indemnify, defend and hold harmless Upper Midwest Outdoors AND ALL RELEASED PARTIES from and against any and all claims, damages, costs or other expenses that arise directly or indirectly out of or from (a) your breach of this Agreement, (b) your violation of the Code of Conduct and/or (c) your activities in connection with the Site or Site-related services.

In making any purchase of products or services described on the Site, you will be asked to supply certain information including but not limited to credit card or other payment information. You agree to pay all charges incurred by users of your account and credit card or other payment mechanism at the prices in effect when such charges are incurred. All orders are checked for accuracy before shipment. Due to the production time involved with some items, you will receive your order within 3 to 10 business days. If you need your order by a specific date, please indicate this in the special instructions section of the order form and we will do our best to accommodate you. If you have ordered an item that is not available or that is delayed, we will notify you of the situation via e-mail. Once an order is shipped, you will be e-mailed. Packages can only be delivered to street addresses.

Upper Midwest Outdoors is not responsible for or liable to you for any delays attributable to the delivery of Products to you, regardless of whether that delay is caused by its sole negligence or that of a third party.

Our goal is 100% customer satisfaction. You can exchange or return any unworn and unaltered piece within 14 days of the receipt date. Please note this does not include any custom orders which are final sale. Shipping and handling on returned merchandise is non-refundable. In order to make a return, please call us to obtain a Return Authorization Number (no exchange or refund will be obtained without a Return Authorization Number). All returns must include a return address, phone number, copy of your receipt, and a letter stating the reason for the return. Please note that RA numbers will expire 7 days after issued. For your protection, please insure the item for its full value and ship the item in a way that you can verify receipt (e.g. UPS or insured Parcel Post).

Upper Midwest Outdoors wants you to be completely satisfied with your purchase. For custom made and special order, most articles are accepted only for credit or exchange, and only if defective in workmanship or quality as determined by Upper Midwest Outdoors. Requests for return must be made within 30 days of date of delivery.

Upper Midwest Outdoors and The UMO Pro Shop reserves the right to refuse to fulfill any order or purchase. In such an event, your payment will be refunded.
